Question 7.

A friend from Nepal has written you a letter describing the political situation there. Many political parties are opposing the rule of the king. Some of them say that the existing constitution given by the monarch can be amended to allow more powers to elected representatives. Others are demanding a new Constituent Assembly to write a republican constitution.

Reply to your friend giving your opinions on the subject.

Answer:

In my opinion, making small amendments does not shift whole power in the hands of representatives. This does not give total responsibility to the elected representatives what will happen in next upcoming years. Hence, a new and well drafted constitution is the correct choice.


Question 8.

Here are different opinions about what made India a democracy. How much importance would you give to each of these factors?

(a) Democracy in India is a gift of the British rulers. We received training to work with representative legislative institutions under the British rule.

Answer:

Democracy in India is not a gift of the British rulers. People of India had to struggle and sacrifice their life to get freedom. Yes, experience working under the legislative constituency helped a lot while setting up of democratic institution.


(b) Freedom Struggle challenged the colonial exploitation and denial of different freedoms to Indians. Free India could not be anything but democratic.

Answer:

Freedom struggle was important in spreading the idea of nationalism throughout the country, and inculcating the practice of making decisions by legal agreement.


(c) We were lucky to have leaders who had democratic convictions. The denial of democracy in several other newly independent countries shows the important role of these leaders.

Answer:

India’s freedom struggle is the only example of a bloodless freedom struggle in contemporary history. The leaders had the intention to give freedoms to the citizens of the country. Our leaders had the maturity to listen to the views of others.


Question 9.

Read the following extract from a conduct book for ‘married women’, published in 1912.

“God has made the female species delicate and fragile” both physically and emotionally, pitiably incapable of self-defence. They are destined thus by God to remain in male protection – of father, husband and son – all their lives. Women should, therefore, not despair, but feel obliged that they can dedicate themselves to the service of men.

Do you think the values expressed in this paragraph reflected the values underlying our Constitution? Or does this go against the constitutional values?

Answer:

The values expressed in this paragraph are totally contradictory to the values underlying our Constitution. Women here are treated as weak, but in our Constitution men and women both are treated equally. The policies made by the government also favour women to bring them into the mainstream.

Read the following statements about a constitution. Give reasons why each of these is true or not true.

(a) The authority of the rules of the constitution is the same as that of any other law.

Answer: Not True

The Constitution describes in detail how the government is elected, their powers, rights of citizens and their protection. This law is very much different from any other law.


(b) Constitution lays down how different organs of the government will be formed.

The Constitution clearly defines the role of the legislature, the executive and the judiciary and also it states how they should be formed and by whom.

नेपाल के एक मित्र ने आपको वहाँ की राजनीतिक स्थिति के बारे में बताते हुए एक पत्र लिखा है। कई राजनीतिक दल राजा के शासन का विरोध कर रहे हैं। कुछ दलों का कहना है कि राजा द्वारा दिया गया वर्तमान संविधान संशोधित करके निर्वाचित प्रतिनिधियों को अधिक शक्तियाँ दी जा सकती हैं। जबकि कुछ अन्य दल एक नई संविधान सभा की माँग कर रहे हैं, जो एक गणतांत्रिक संविधान बनाए।

इस विषय पर अपनी राय देते हुए अपने मित्र को उत्तर लिखिए।

उत्तर:

मेरे विचार में केवल छोटे-छोटे संशोधन करने से पूरी शक्ति निर्वाचित प्रतिनिधियों के हाथों में नहीं आ जाएगी। इससे निर्वाचित प्रतिनिधियों को भविष्य के लिए पूरी जिम्मेदारी और अधिकार नहीं मिल पाएँगे। इसलिए एक नया और अच्छी तरह से तैयार किया गया संविधान बनाना अधिक उचित विकल्प है।


प्रश्न 8.

भारत को लोकतंत्र बनाने में किन कारणों का योगदान रहा, इसके बारे में अलग-अलग विचार दिए गए हैं। आप इनमें से प्रत्येक कारक को कितना महत्व देंगे?

(क) भारत में लोकतंत्र ब्रिटिश शासकों की देन है। ब्रिटिश शासन के दौरान हमें प्रतिनिधि विधायी संस्थाओं के साथ काम करने का प्रशिक्षण मिला।

उत्तर:

भारत में लोकतंत्र ब्रिटिश शासकों की देन नहीं है। भारत के लोगों ने स्वतंत्रता प्राप्त करने के लिए संघर्ष किया और अनेक लोगों ने अपने जीवन का बलिदान दिया। हाँ, ब्रिटिश शासन के दौरान विधायी संस्थाओं के साथ काम करने का अनुभव भारत में लोकतांत्रिक संस्थाओं की स्थापना में काफी सहायक रहा।


(ख) स्वतंत्रता संघर्ष ने औपनिवेशिक शोषण और भारतीयों को विभिन्न स्वतंत्रताओं से वंचित करने की चुनौती दी। स्वतंत्र भारत लोकतांत्रिक हुए बिना कुछ और हो ही नहीं सकता था।

उत्तर:

स्वतंत्रता संघर्ष ने पूरे देश में राष्ट्रवाद की भावना को फैलाने में महत्वपूर्ण भूमिका निभाई। इस संघर्ष ने लोगों में सामूहिक निर्णय लेने और आपसी सहमति से निर्णय करने की भावना को भी विकसित किया।


(ग) हम भाग्यशाली थे कि हमारे पास ऐसे नेता थे जिनकी लोकतंत्र में गहरी आस्था थी। कई अन्य नए स्वतंत्र देशों में लोकतंत्र का अभाव इन नेताओं की महत्वपूर्ण भूमिका को दर्शाता है।

उत्तर:

भारत के स्वतंत्रता संघर्ष के नेताओं में लोकतांत्रिक मूल्यों के प्रति गहरी आस्था थी। इन नेताओं का उद्देश्य देश के नागरिकों को स्वतंत्रता और अधिकार देना था। हमारे नेताओं में दूसरों के विचारों को सुनने और उनका सम्मान करने की परिपक्वता थी।

1912 में प्रकाशित विवाहित महिलाओं के लिए एक आचरण-पुस्तक के निम्नलिखित अंश को पढ़िए:

क्या आपको लगता है कि इस अनुच्छेद में व्यक्त मूल्य हमारे संविधान में निहित मूल्यों को दर्शाते हैं? अथवा ये संवैधानिक मूल्यों के विरुद्ध हैं?

उत्तर:

इस अनुच्छेद में व्यक्त मूल्य हमारे संविधान में निहित मूल्यों के बिल्कुल विपरीत हैं। इसमें महिलाओं को कमजोर और पुरुषों पर निर्भर बताया गया है, जबकि हमारे संविधान में पुरुषों और महिलाओं दोनों को समान माना गया है। सरकार द्वारा बनाई गई विभिन्न नीतियाँ भी महिलाओं को मुख्यधारा में लाने और उन्हें समान अवसर प्रदान करने का प्रयास करती हैं।


प्रश्न 10.

संविधान के बारे में निम्नलिखित कथनों को पढ़िए। प्रत्येक कथन के सही या गलत होने के कारण बताइए।

भारत का संविधान लोकतंत्र, न्याय, स्वतंत्रता, समानता, धर्मनिरपेक्षता और बंधुत्व जैसे मूल्यों पर आधारित है। संविधान सभा के सदस्यों ने विभिन्न विचारों और मतभेदों के बावजूद व्यापक चर्चा और सहमति के माध्यम से भारतीय संविधान का निर्माण किया।

1. संविधान क्या है? | What is a Constitution?

संविधान किसी देश के शासन को चलाने वाले मूलभूत नियमों और सिद्धांतों का लिखित दस्तावेज है।

यह बताता है कि—

  • देश में सरकार कैसे बनेगी?
  • सरकार के पास कितनी शक्तियाँ होंगी?
  • नागरिकों के क्या अधिकार होंगे?
  • सरकार नागरिकों के साथ कैसा व्यवहार करेगी?
  • नागरिकों के बीच समानता और न्याय कैसे सुनिश्चित होगा?

A Constitution is a set of basic rules and principles according to which a country is governed.

It tells us:

  • How the government will be formed.
  • What powers the government will have.
  • What rights citizens will enjoy.
  • How the government should treat its citizens.
  • How equality and justice will be ensured.

It puts limits on the powers of the government.

सरकार जो चाहे वह नहीं कर सकती।


③ नागरिकों के अधिकारों की रक्षा

It protects the rights of citizens.

जैसे—

  • समानता का अधिकार
  • स्वतंत्रता का अधिकार

④ समाज के सामूहिक लक्ष्यों को व्यक्त करना

It expresses the aspirations and goals of the people.

Apartheid दक्षिण अफ्रीका में नस्लीय भेदभाव की व्यवस्था थी।

भारत की संविधान सभा का गठन 1946 में हुआ।

इसके सदस्य मुख्य रूप से प्रांतीय विधानसभाओं के निर्वाचित सदस्यों द्वारा चुने गए थे।

10. Jawaharlal Nehru और Objective Resolution

13 December 1946 को जवाहरलाल नेहरू ने Objective Resolution (उद्देश्य प्रस्ताव) प्रस्तुत किया।

इसमें भारत के भविष्य के संविधान के मूल उद्देश्यों की रूपरेखा दी गई।

बाद में इसी के विचारों ने Preamble (प्रस्तावना) के निर्माण में महत्वपूर्ण भूमिका निभाई।

13. भारतीय संविधान की प्रस्तावना

The Preamble

प्रस्तावना संविधान का परिचय देती है और बताती है कि भारत किस प्रकार का राष्ट्र है तथा उसके प्रमुख उद्देश्य क्या हैं।

भारत को कहा गया है:

Sovereign – संप्रभु

भारत अपने निर्णय स्वयं लेता है।

Socialist – समाजवादी

सामाजिक और आर्थिक असमानताओं को कम करने तथा कल्याणकारी व्यवस्था की दिशा में प्रतिबद्धता।

Secular – धर्मनिरपेक्ष

राज्य किसी एक धर्म को अपना आधिकारिक धर्म नहीं मानता और सभी धर्मों के प्रति समान व्यवहार का संवैधानिक सिद्धांत रखता है।

Democratic – लोकतांत्रिक

लोग अपने प्रतिनिधियों को चुनते हैं।

Republic – गणराज्य

देश का राष्ट्राध्यक्ष वंशानुगत राजा नहीं होता; भारत में राष्ट्रपति निर्वाचित होता है।


14. प्रस्तावना के चार प्रमुख आदर्श

यह exam में बहुत पूछा जाता है।

① Justice – न्याय

भारत में तीन प्रकार के न्याय की बात की गई है:

  • Social Justice – सामाजिक न्याय
  • Economic Justice – आर्थिक न्याय
  • Political Justice – राजनीतिक न्याय

② Liberty – स्वतंत्रता

नागरिकों को विचार, अभिव्यक्ति, विश्वास, धर्म आदि की स्वतंत्रता।

Liberty of thought, expression, belief, faith and worship.


③ Equality – समानता

सभी नागरिकों को समान दर्जा और अवसर।

Equality of status and opportunity.


④ Fraternity – बंधुता

देश के सभी नागरिकों में भाईचारे की भावना।

इसका उद्देश्य व्यक्ति की गरिमा और राष्ट्र की एकता-अखंडता को बढ़ावा देना है।


15. संविधान निर्माण की प्रक्रिया

भारत का संविधान अचानक तैयार नहीं हुआ था।

संविधान सभा ने लगभग तीन वर्षों तक चर्चा और बहस की।

सदस्यों ने अलग-अलग मुद्दों पर—

  • चर्चा की,
  • बहस की,
  • संशोधन सुझाए,
  • और फिर निर्णय लिए।

इसलिए संविधान की विशेषता क्या है?

17. संविधान में विविधता का ध्यान

भारत एक बहुत विविध देश है।

हैं।

इसलिए संविधान निर्माताओं ने ऐसी व्यवस्था बनाने की कोशिश की जिससे अलग-अलग समूहों को लोकतांत्रिक व्यवस्था में स्थान और अधिकार मिल सकें।


18. संविधान क्यों सफल हुआ?

NCERT का एक महत्वपूर्ण विचार यह है कि भारत का संविधान केवल नेताओं द्वारा बनाया गया दस्तावेज नहीं था।

इसके पीछे स्वतंत्रता आंदोलन के दौरान विकसित हुए कई लोकतांत्रिक विचार थे।
